Agreement to Terms

These Terms of Service ("Terms") govern your use of the website and game at https://scrappaperparty.com/ (the "Service"), operated by Hanna Qumsiyeh ("we," "us," or "our").

By accessing or using the Service you agree to these Terms. If you do not agree with them, please do not use the Service.

Nothing in these Terms limits or excludes any right you have under the mandatory consumer protection law of the country you live in. Where these Terms and that law conflict, that law wins.

What the Service Is

Scrap Paper Party is a free, browser-based multiplayer party game. Players join a shared party — up to ten people — and play short rounds of drawing, word and guessing games together, scoring points as they go.

There is no account, no sign-up, and no password. To play you choose a display name, and that is all we ask for.

The Service is an independent hobby project offered free of charge. It is not a company. There is no subscription, no purchase, and nothing to buy. If you choose to support it financially, that happens on a separate site (see "Donations").

Eligibility and Age

You must be at least 13 years old to use the Service. That is a condition of these Terms.

Some features work differently for younger users. Where we rely on your consent for something — which, in practice, means the optional feedback form — a child below the consent age that applies in their country should have a parent or guardian's permission first. Playing the game does not rest on consent, so this is not a bar on younger children playing; the Privacy Policy explains the distinction in detail under "Children's Privacy," and that explanation is the fuller one.

The Service is made for a general audience and we do not market it to children. We do not ask for anyone's age and have no way to verify it. If you are a parent or guardian and believe a child has provided personal information through the Service, contact us and we will remove it.

Acceptable Use

The Service is played with other people, most of whom will be strangers. Please behave accordingly.

You agree not to:

• Use the Service in any way that breaks any applicable law or regulation
• Draw, type, or send anything harassing, threatening, hateful, sexually explicit, or otherwise abusive toward another player
• Impersonate another person, or choose a display name intended to deceive
• Submit content that infringes anyone's copyright, trademark, privacy, or other rights
• Post other people's personal information, whether in a drawing, a chat message, a display name, or the feedback form
• Attempt to gain unauthorised access to any part of the Service, its server, or another user's session
• Interfere with or disrupt the Service, including by exploiting bugs, tampering with the game client, or sending falsified messages to the server
• Use any automated system, bot, or script to access or play the Service, or to send more requests than a person could reasonably produce

Content Filtering and Moderation

The Service applies automatic filtering to display names and chat messages. Display names containing matched terms are rejected outright; matched terms in chat are masked. This filter is a blunt instrument: it will miss things, and it will occasionally catch something innocent. It is not a substitute for behaving decently.

We do not read or monitor gameplay or chat as it happens — there is no moderation team, and no record of a party survives the end of it. This means that in practice, most misbehaviour cannot be reported to us after the fact, because by the time you tell us there is nothing left for us to look at.

The tools that exist are in your hands during play: parties can vote to remove a player, and the host can remove a player directly.

Removal From a Party

Because there are no accounts, "removal" happens at the level of a single party rather than the Service as a whole:

• Other players in your party can vote to remove you. A player removed this way keeps their score and can return in the next round.
• The host of a party can remove any player from it directly.

These are player-operated tools. We do not adjudicate their use, and we may not be aware of it at all.

We may also suspend or block access to the Service ourselves, without notice, if we believe it is being used in breach of these Terms — for example to attack the server, exploit the game, or harass other players. Given the design of the Service, the practical form this takes is usually a technical block rather than a ban on an account, since there are no accounts to ban.

Your Content

You keep ownership of everything you make with the Service — your drawings, the names you invent, your answers and your chat messages.

To operate the game we need permission to show your content to the people you are playing with. By submitting content you grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, transmit and display it for the purpose of operating the Service. This licence exists only so the game can function, and it ends when your content does — which, in practice, is when your party ends.

We do not claim ownership of your content, we do not use it for advertising, and we do not sell it or license it to anyone else.

Please understand what "showing your content to other players" actually means: everything you draw, type or send is visible to the other people in your party, and we cannot control what they do with it. They can take screenshots. Do not draw or type anything you would mind a stranger keeping.

Feedback

If you send us feedback through the feedback form, you agree that we may use it without restriction and without any obligation to you — to fix bugs, change the game, or build new features. You are not entitled to payment or credit for it, and we are not obliged to act on it or reply.

Please do not include personal information in feedback. The form says so, and we mean it.

Donations

The Service is free. There is nothing to buy, and no feature is withheld behind a payment.

If you would like to support the project, the "Support the game" button links to our page on Buy Me a Coffee. That is a separate service run by a separate company, with its own terms and its own privacy policy. Any payment you make happens entirely on their site: your card and billing details go to them and their payment processors, and never reach us.

Donations are voluntary gifts. They are not a purchase, they buy no goods, services, features, advantage or priority within the game, and they are not refundable by us — we never receive your payment details and have no ability to reverse a transaction. Any refund question is a matter for Buy Me a Coffee and their processor.

Availability — Please Read This One

The Service is free and runs on free hosting. That has consequences you should expect rather than be surprised by:

• The server sleeps when nobody has used it for a while. The first visit after that can take up to a minute to load while it wakes up.
• The server can restart at any time, without warning.
• Everything about a game lives in the server's memory. A restart therefore ends every game in progress. Scores, drawings and chat from that party are gone, and cannot be recovered by us or anyone else.
• There is no backup of any of it, because there is nothing stored to back up.

We do not promise the Service will be available, uninterrupted, or free of errors. We may change, suspend or discontinue it — in whole or in part — at any time, without notice and without liability. It is a hobby project, and it may simply stop one day.

Intellectual Property

The Service itself — its source code, artwork, written copy, game designs, name and branding — belongs to Hanna Qumsiyeh and is protected by copyright and other laws. This does not include content submitted by users, which remains theirs as described in "Your Content."

You may not copy, modify, distribute, sell or lease any part of the Service, or reverse engineer it, except to the extent that applicable law expressly permits it despite this restriction.

The name "Scrap Paper Party" and the site's branding may not be used in connection with any other product or service without our prior written consent.

Copyright and Rights Complaints

Players draw and type their own content, and we do not review it in advance. If you believe content shown through the Service infringes your copyright or other rights, contact us at support@scrappaperparty.com with:

• A description of the work or right concerned
• A description of what you believe infringes it, and where you saw it
• Your contact details
• A statement that you believe in good faith the use is not authorised
• A statement that the information in your notice is accurate

We will review it and remove anything within our control. Please note that because nothing is stored, content shown during a game usually no longer exists by the time a complaint reaches us.

Disclaimer of Warranties

The Service is provided "AS IS" and "AS AVAILABLE," without warranty of any kind, express or implied. To the fullest extent permitted by law we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, non-infringement and course of performance.

We do not warrant that the Service will meet your requirements, that it will be available, uninterrupted, secure or error-free, or that any defect will be corrected.

Nothing in this section affects rights you have as a consumer under the mandatory law of the country you live in.

Limitation of Liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data, goodwill or other intangible losses, arising out of or relating to:

• Your access to or use of, or inability to access or use, the Service
• The conduct or content of any other player or third party on the Service
• Any content obtained through the Service
• Unauthorised access to or alteration of your transmissions or content
• The loss of any game, score or drawing, including through a server restart

Because the Service is provided free of charge, our total aggregate liability to you for all claims relating to it is limited to zero, or to the minimum amount permitted by applicable law if that law does not allow a limitation to zero.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited. If you are a consumer, nothing here removes your statutory rights.

Indemnity

To the extent permitted by law, you agree to indemnify and hold us harmless from any claim or demand — including reasonable legal costs — made by a third party arising out of your breach of these Terms, your misuse of the Service, or your infringement of someone else's rights. This does not apply to the extent the claim arises from our own breach or negligence.

Privacy

Your use of the Service is also governed by our Privacy Policy, which explains what information the Service handles and why. Please read it.

Governing Law and Disputes

The Service is operated from Budapest, Hungary. These Terms are governed by the laws of Hungary, without regard to its conflict of law rules, and the courts of Hungary have jurisdiction over any dispute arising from them.

If you are a consumer, this does not deprive you of the protection of the mandatory consumer law of the country you live in, and it does not stop you bringing proceedings in the courts of that country. Under Article 6 of the Rome I Regulation, a consumer keeps the protection of their home country's law whatever this clause says, and nothing here is intended to change that.

If any part of these Terms is held invalid or unenforceable, that part will be limited or removed to the minimum extent necessary, and the rest will remain in full force.

Our failure to enforce any right or provision is not a waiver of it.

You may not transfer or assign these Terms or any rights under them. We may transfer ours to a successor if the project is ever handed on, provided your rights under these Terms are not reduced.

These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Service, and replace any earlier version.

Changes to These Terms

We may modify these Terms at any time. If a change is material we will try to give at least 30 days' notice before it takes effect, by posting the revised Terms on this page and updating the "Last Updated" date.

By continuing to use the Service after a change takes effect, you accept the revised Terms. If you do not accept them, please stop using the Service — which, as there is no account to close, you can do simply by closing the page.
